The organization “South Dakota For Better Marijuana Laws” is filing to intervene in the legal challenge of Amendment A.
The constitutional amendment that legalizes recreational marijuana passed with 54 percent of the vote earlier this month.
The Pennington County Sheriff and South Dakota Highway Patrol Superintendent filed a lawsuit alleging the amendment was not legally ratified by voters. They claim the state constitution can only be changed by amendments or revisions, not by introducing new articles.
Drey Samuelson is the political director for South Dakotans for Better Marijuana Laws. He says they’re prepared to defend Amendment A against the lawsuit and are working on a legal strategy.
Robert Morris and Matthew McCaulley are attorneys for the plaintiffs. McCaulley is an attorney that advises Governor Noem.
