Judiciary Committees Approve Curbing Prosecutor Control Over Expunging Arrests

A highly controversial prosecution in Aberdeen is the apparent impetus behind changing a South Dakota law. House Bill 1134 responds to the prosecution of a former Brown County deputy state’s attorney, Brandon Taliaferro (pronounced “Toliver”). If passed, the law removes a prosecutor’s power to block arrest records from being expunged without a hearing, no longer giving prosecutors the last word when it comes to removing certain arrest records from public scrutiny. SDPB’s Victoria Wicks reports on testimony heard before the House and Senate Judiciary Committees of the South Dakota legislature.
