A highly controversial prosecution in Aberdeen is the apparent impetus behind changing a South Dakota law. House Bill 1134 responds to the prosecution of a former Brown County deputy state’s attorney, Brandon Taliaferro (pronounced “Toliver”). If passed, the law removes a prosecutor’s power to block arrest records from being expunged without a hearing, no longer giving prosecutors the last word when it comes to removing certain arrest records from public scrutiny.
