Landowners challenge state in court over new men's state prison location

Landowners from Lincoln County had their day in court against the state and its proposed men’s prison location.

The Neighbors Opposed to Prison Expansion, or NOPE, challenged the state’s ability to surpass county zoning ordinances.

The hearing was held in the Second Judicial Court by judge Jennifer D. Mammenga. The state said they have the right to build the prison -their largest point being that they own the land.

NOPE members hope to set a new precedent. They believe the state should have to comply with local county zoning rules.

Mammenga said she will have a written decision in the coming weeks.
