Jackley signs letter opposing proposed ATF background check rule

South Dakota Attorney General Mary Jackley is joining an effort asking the Bureau of Alcohol, Tobacco and Firearms to drop a proposed civil liability rule on firearm sales.

The rule would expand what type of gun sales are subject to federal regulations.

President Joe Biden's office announced the rule in August, saying it closes loopholes allowing firearms sold online or at gun shows to avoid background checks. White House officials said it's part of an effort to keep guns out of the hands of criminals.

Jackley said the rule violates the second amendment.

“This civil liability rule would penalize innocent citizens selling their guns to friends and family,” Jackley said in a statement released Tuesday. “Washington is continuing to infringe upon the rights of law-abiding citizens. This is nothing more than the current administration’s attempt to drive up the cost of firearms for lawful citizens.”

Jackley joined 24 other attorneys general in sending a public comment letter to the ATF opposing the proposed rule.
