South Dakota ICWA advocates weigh in on Supreme Court's decision | In The Moment

This interview originally aired on In the Moment on SDPB Radio.

South Dakota Rep. Peri Pourier and South Dakota ACLU legal director Stephanie Amiotte, both of the Oglala Lakota Nation, join In the Moment to break down the Supreme Court's decision to uphold the Indian Child Welfare Act. This act, known as ICWA, gives preference to tribal members when considering the adoption and foster placements of native children.

The ruling is seen as a victory for tribes, who said overturning the legislation would endanger their right to govern themselves as independent people.

Justices Thomas and Alito wrote dissenting opinions on the decision.

The court ruled in favor of the prior legislation 7-2.
