Senate amends ag nuisance claim bill

A bill protecting agriculture producers against nuisance lawsuits is headed back to the House after getting amended in the Senate.

House Bill 1090 tightens restrictions on filing nuisance claims against farm operations.

The bill, which is backed by Gov, Kristi Noem, breezed through the House earlier this session.

On Friday, Sen. David Wheeler amended the bill to expand when producers can be sued. It also expanded protections to both owners and lessees.

Senators approved the bill as amended in a 25 to 8 vote. It now heads back to the House for approval.
