Officials Say Supreme Court Decision Unlikely To Change State Abortion Laws

Both abortion rights advocates and opponents in South Dakota agree the recent US Supreme Court decision on a Texas case won’t immediately affect current state law.

Libby Skarin is a policy director for the ACLU in South Dakota. She says while the Supreme Court’s decision won’t directly impact state law, it may quell any additional laws that seek to regulate abortion.

“This week’s decision, I think, should send a loud message to our anti-abortion politicians that they can no longer hide behind the sham rationales to shut down clinics and to prevent women from seeking abortions," Skarin says.

But Attorney General Marty Jackley says the Supreme Court decision on the case in Texas is a different issue than current South Dakota law.

Jackley says laws in South Dakota are designed to provide more information to individuals who are considering an abortion, or “informed consent.”

Jackley says, overall, the state’s laws are reasonable and constitutional.
