6th Circuit Splits; Same-Sex Marriage Issue Headed To U.S. Supreme Court

In early October the U.S. Supreme Court declined to take on the issue of gay marriage. Circuit courts of appeals had been uniformly ruling that states’ bans on same-sex marriage are unconstitutional.
