Blank Ballot Explanation Spots Land Secretary of State in Court

A State Senator from Rapid City is taking the South Dakota Secretary of State to court.

State Senator Stan Adelstein says Secretary Jason Gant broke the law when he left an opposing statement against Constitutional Amendment “P” off the ballot explanation.

Adelstein contends it’s up to the Secretary of State to provide language in a ballot explanation that describes both sides of any constitutional amendment.   

Amendment P changes the constitution to require a balanced budget.   But, Adelstein says the state constitution already requires that.  

Gant allegedly left the opposing side of all the proposed amendments off the current ballot explanation booklets.   The on-line publication on the Secretary of State’s website shows a blank space for the opposing side of each amendment.

The issue is first set to be heard  in Hughes County Court before Judge Mark Barnett  on this Friday, October  12th beginning at 12:30 PM.
