SDPB is committed to complying with all regulations and making our information easily accessible to the public. Our public inspection files for television and radio are maintained, pursuant to FCC permission, on the campus of the University of South Dakota, Al Neuharth Media Center, 555 N. Dakota Street, Vermillion, SD 57069. They are available for viewing to the general public during regular business hours 8:00 a.m. to 5:00 p.m., Monday through Friday and printed copies are available. FCC Applications

89.1 MHz, Mitchell, South Dakota
On November 8, 2021, South Dakota Board of Directors for Educational Telecommunications, applicant for a new noncommercial FM station on 89.1 MHz, Mitchell, South Dakota, filed an application with the Federal Communications Commission for a construction permit for the new station. Governance
SDPB is governed by the South Dakota Board of Directors for Educational Telecommunications, which also holds licenses for all SDPB broadcast facilities. Members of the board are appointed by the Governor of the state of South Dakota. Current members of the South Dakota Board of Directors for Educational Telecommunication are:

SDPB adheres to the open meetings requirement prescribed by the Corporation for Public Broadcasting. The Board of Directors meets “as often as necessary to perform its duties” (§ 13-47-5). Meetings are typically held quarterly at locations around the state. Friends of SDPB is a non-profit 501(c)(3) corporation, which has the purpose to support the mission of South Dakota Public Broadcasting through effective advocacy and fundraising, and to carry on other charitable activities associated with this purpose as allowed by law. Members of the Friends of SDPB Board of Directors are elected from the population at large.

The Board serves as the Community Advisory Board, advising SDPB regarding the Community Problems and Needs and assisting SDPB in furtherance of its mission: To use the power of public media to connect South Dakotans with education, information, culture and the arts.

“Each year, the Board shall hold at least one meeting, at a time and place fixed by the Board, for the purposes of election of Directors, appointment of Officers, review and approval of the corporate budget and transaction of other business. This meeting is sometimes referred to in these Bylaws as the ‘annual meeting.’ Other regular meetings of the Board may be held at such time and place as the Board may fix from time to time by resolution.” (Article 7, Section 5 – Friends of SDPB Bylaws) Meetings of the Board of Directors of Friends of SDPB are open to the public. Community Representation Statement
 (*The Communications Act requires the Corporation for Public Broadcasting to support diverse non-commercial educational content for unserved and underserved audiences and to make public media’s content available for free to rural and urban audiences throughout the United States. Locally owned and operated public media stations are uniquely connected to America’s communities and positioned to reflect and serve the diverse and varying populations of their communities.

 CPB encourages stations to continue to reflect and include their communities in station employment, membership on boards primarily responsible for station governance, community advisory boards (if required) and to provide educational, informational, and cultural content that meets the need of the community populations they serve. Station activities and practices in support of these objectives must be consistent with the Equal Employment Opportunity provisions in the General Provisions and with other applicable federal and state laws.

To affirm this ongoing commitment, stations are required to adopt a “Community Representation Statement” that documents their support of these goals and how they plan to achieve them. The Community Representation Statement must be posted on the station’s website or made available at its central office. Stations must biennially review their Community Representation Statements with their governing body and modify them as necessary to reflect significant changes in their communities’ populations served and their strategies to serve them.)

As a media organization, SDPB is responsible for reflecting the issues, cultures, and lives of South Dakota residents. SDPB, as a member of a free and independent press, reports without fear or favor and provides nonpartisan news coverage for the entire community, including historically underserved communities. SDPB’s live coverage of the South Dakota Legislature provides an open door to government and allows all to share equally in the legislative process.

SDPB, as a key voice in the South Dakota music scene, broadens cultural understanding, exposing listeners to new cultures and communities through music.

SDPB is an equal-opportunity employer and includes staff from a wide range of backgrounds. We are members of NPR’s Public Media Village recruitment measures. SDPB partners with Mahpiya Luta (Red Cloud Indian School) to pilot a youth content project. SDPB also offers internships geared toward developing a pipeline of talent for public media, and the station participates in job fairs and other outreach.

Friends of SDPB board of directors serves as an ad hoc community advisory board. This board provides advice and direction on community issues and the station’s public service strategy.

The SDPB Education department develops, distributes, and promotes learning opportunities and classroom resources that may be implemented in public and private classrooms and in homeschooling situations that meet state standards and address issues of diverse learning.

SDPB produces content shared on multiple platforms and designed to reach underserved communities. Programs about the protection of the Siouan languages, the traditional ways of Indigenous peoples, news and events in Indian Country, and stories about residents of other ethnic backgrounds are produced and presented on TV, Radio, and online.

SDPB explores music of all genres through partnerships with the South Dakota Symphony Orchestra and the Levitt Shell in Sioux Falls.

Closed Captioning Certification
All programming provided by SDPB, KUSD-TV complies with the closed captioning requirements published by the Federal Communications Commission as embodied in 47 C.F.R.§ 79.1, including regulations concerning closed captioning quality. Programming provided by KUSD-TV complies with these regulations by either: (i) satisfying the caption quality standards set forth in 47 C.F.R. § 79.1 (j) (2); (ii) adopting and following the “Video Programming Best Practices” set forth in 47 C.F.R.. § 79.1 (k) (1); or (iii) being subject to one or more of the captioning exemptions set forth in 47 C.F. R. § 79.1 (d), including programming for which the audio is in a language other than English or Spanish and that is not scripted programming that can be captioned using the “electronic news room” technique; interstitial material, promotional announcements, and public service announcements that are 10 minutes or less in duration; and/or programming that consists primarily of non-vocal music.

SDPB is South Dakota. Diversity throughout SDPB is important for the success of our organization. We are stronger, more credible, more knowledgeable and more effective when our board of directors, community advisory board, management and staff include qualified individuals with diverse backgrounds, cultures and traditions that are varied and reflect the composition of our state.
