The South Dakota Supreme Court has overruled an earlier opinion concerning intentional infliction of emotional distress in divorce cases. In 1989 the court ruled that a former spouse can't sue the other spouse for intentional infliction if that behavior led to the divorce. Now the supreme court has reconsidered.
