Challenge To SD's Gay Marriage Bans Goes Forward In Federal Court

On Friday a federal judge ruled that a lawsuit can continue against the state of South Dakota for its refusal to recognize the legality of same-sex marriages. The state asked that the suit be dismissed, saying that previous court decisions made the suit invalid and that voters should define marriage. But federal judge Karen Schreier says more recent decisions prevail. Plaintiffs have now filed a request for summary judgment, and the state has until November 24th to respond.
